In what should be no surprise, word is out that a North Carolinas Builders Association, in unison with a new group formed for the law suit called the Union Landowners Association and a local builder have filed suits to over-turn the county’s recently enacted Adequate Public Facilities Ordinance.

The APFO was passed in October by the county commissioners (search on APFO) is designed to time new subdivisions based on the local schools capacity to seat students generated by the new project.

The APFO is the only growth-management ordinance enacted by Union County to meter the home-building tsunami that has lead to over-crowded schools, 10% annual growth in student enrollment and school construction unable to keep pace.
